An anonymous expert witness recently posted a review of an article from the Fall 2011 issue of Dunn on Damages–The Economic Damages Report for Litigators and Experts.  The article, titled Sue Your Expert–Liability of Expert Witnesses for Damages, reviews key court decisions allowing or dismissing claims against expert witnesses for negligence and malpractice.  As the reviewer comments:

experts particularly may be exposed to legal challenges from their own clients, especially for the work leading to courtroom testimony

This potential legal liability exposure

underline(s) the need for experts to ensure that work performed to develop expert testimony complies with appropriate procedures and generally accepted practices for litigation-related work.
