From 2017 to 2018, Courtroom Insight, Daubert Tracker, and Expert Witness Profiler conducted a survey on expert witness research. In sum, the survey aimed to developed a better understanding of common research and retention techniques. Overall, 580 legal professionals, including attorneys, law librarians and paralegals, participated the survey. Unfortunately, the survey revealed the sad reality of expert witness research workflows. <\/p>\n\n\n\n

Jean O’Grady, legal tech author at Dewey B Strategic, noted several shocking findings in Courtroom Insight’s survey results:<\/p>\n\n\n\n

    \n
  1. Low referral usage: 50% of legal professionals have never used an expert witness referral firm. Out of the used firms, Tasa and Round Table Group Thomson Reuters West were the most popular for referrals.<\/li>\n\n\n\n
  2. Negative perspectives: Expert witness referral firms are viewed as a last resort effort. <\/li>\n\n\n\n
  3. Surprising discoveries: 60% of individuals have been surprised by at least one aspect of an expert background or expertise. This includes discovering that the expert was sued, accused of malpractice, had a criminal history, plagiarized documents, or falsified their resume.<\/li>\n\n\n\n
  4. Poor knowledge management: 70% of respondents file expert witness information with the case file and do not map it to an internal resource.<\/li>\n<\/ol>\n\n\n\n
